Can i refuse to give statement to police

As earlier we complaint at police station on writing against land grabber who were trying to grab our land but police didnt taken actions against them and instead of applying criminal and land forgery act they only done chapter case and arranged bail on paper without arresting land grabber. After that we filled civil case and now it is on stay order stage.

My query is that we complaint using online complaint portal to PM Narendra Modi regarding the police actions and land grabbing case. The complaint came back to the police station where we complaint earlier and now the police is forcing us to give the statement. As our lawyer advised us to not to give any statement to police because the civil case is running at court. Hence we receive calls from police station and they are forcing us to give statement. We believe that if we give any statement it will affect to our civil case and we will not get the stay order.

1. So I want to know that can we refuse to give statement to police or can the police force to give statement ??

2. If I dont give statement can they come to our home to take statement forcefully ?

3. what actions can be taken in this case if police are forcing for statement and calling at police statement ??

The Police complaint was made by you and as a complainant you cannot refuse to record your statement to police. The information about land grabbing was reported by you from whatever website that hardly matters. The fact if intentionally false information supplied by you to police than you can face criminal charges yourself and that will be construed by the police if you refuse to record your statement. You can always state the real facts of the matter, tell that now civil suit has been initiated by you after waiting for the police action for long period and during the pendency of the civil suit in the court you don't want to add anything more what you stated in your complaint to them.

If there is any reality in your case and you do not prefer to make statement before the police with reference to your own complaint, the police will free to close the case by wring your refusal for statement by taking witnesses even from your neighbors.

Make sure to be honest in giving full description of your discussion with your own lawyer, who is fighting your case, as you have not stated your views with particular reference to your own 2nd and 3rd questions.

Question No.1 could be understood with reference to your description, but is there any specific reason that you have not asked Q. No. 2 & 3 from your own lawyer, when you have hired his service to fight your civil case and is stated to have forbidden you to make any statement before the police?

That way, the reality of the problem becomes doubtful.

Please clarify.

Earlier we complained to police but police didnt take any actions and with this benefit the land grabber created false documents and filled false civil case against us thats why we Complaint to online greviance against police actions and village talati and sarpanch who created false documents. The application was forwarded back to police station where we complained.

The land grabber has filled civil suit with false documents and he is directly connected with police. The police wants to help land grabber and create evidence from our statement and with the statement police wants to show the actions on paper which will create good proof for land grabber to stand at court stating that we are threatening them by police power...thats why we dont want to give statement to police.

Earlier we informed the Police Officer that our civil case stage is on stay order at court thats why we dont want to give statement right now and he agreed but now he is told other officer to force us for statement who is forcing us since 2 days.

In your first post you stated you filled civil case, now you say the land grabber filled civil case, you are yourself not clear with your facts. It seems this not actual matter but academic in nature, just wasting time of experts for free of cost.
Better engage lawyer and get paid services for the case discussion.

Your attempt is a sheer intention of misuse of free services of the experts with your fabricated stories.

Even if there is even a little bit of truth in your ever changing stories, it will be better for you to rely on your own lawyer.

Sorry it was by mistake typen....we filed civil counter claim againt the civil suite filed by land grabber....as i am not of tha field so bymistakenly typen and the person who is in troubld are always doing mistakes that doesnt mean that the person are misusing free services or intention to waste someones time...

Anyways if u uderstand try to help otherwise dont use bitter words..

As your post the complaint with PMO has landed in PS.
That is why you are being called to give statement.
Discuss with our own very able senior LOCAL counsel of unshakable repute and integrity specializing in civil matters and having successful track record….
If you are not satisfied with your counsel change and approach another senior counsel..
It may cost you some FEE but you should be satisfied.
