Joint property Dispute

Querist : Anonymous (Querist) 06 February 2018 This query is : Resolved
Sir
I have a 350 sq yards house in Panchkula Haryana jointly owned by my widow mother and elder brother. The plot was transferred to us after the death of my father and we build a house on it in 1985.
Sir now due to our family Dispute I don't want to live with my brother but my brother is not agreeing in selling of the house.
The house has only ground floor and only one electric meter which is in the name of my brother. As he is a rich man and uses all type of electrical equipments the average bill is around RS 30000 for 2 months. I have to pay half of it. I have tried but M C does not give separate meter and my brother also does not agree to sub meter.
Now can you please guide me that is I file a case I the court what verdit the court can give and how much time will it take.
The house is in the name of me my mother and brother
Thanks

Partition of the property through court too will ultimately result in selling the property in open market and distribution of 3 shares to each of the three owners. The time taken for the same will be number of years which cannot be clarified just like this as civil litigation all know is very long drawn process.
Second option is that you built another floor and shift on that floor and apply a new electricity connection for the floor.
Third option on the roof of the house install Solar Power Plant of 8-10 KW that will get average of 35-40 Unit electricity daily saving a lot on electricity bill every month. (My personal experience)
Apart from these 3 options I have no other to provide you here, anyone else expert may be there to help you.

You can release your share in favour of your brother, on getting payment from him (You told that he is a rich man and pays Rs.30,000 for two months for electricity alone).
By the money, you get from your brother, buy a plot and construct your own house.
