Employers fooling around

Querist : Anonymous (Querist) 04 January 2018 This query is : Resolved
Hi,

I need your help in solving my current situation. I work for ABC company but my payroll company is 123. I have signed a bond of 1 year which says that I need to serve the ABC company for 1 year & if I resign before that, I will have to pay 50k against the bond. The probation period from 123 company is 3 months & I have succesfully completed my probation. (I'm a female employee).

The issue is, I had applied for 5 days of leaves one month back to my ABC manager (8 days in total including weekend). My manager approved only for 2 days & rejected for 3 days. So I personally requested him a lot & his manager to approve all the leaves as they were important to me since I had to travel. He did not agree. So I had no choice, but take sick leaves for 2 days. I was resuming to work for the 3rd day and raised transport request. I later came to know that my transport request requires my ABC manager's approval, only then they can provide me cab. I was confused as to what happened suddenly. Then I received an SMS from my 123 manager asking me to cancel my cab & not attend office the next day as he wanted to discuss something with me before I resume to work. I followed his instructions & cancelled my cab & texted my ABC manager that I have cancelled my cab & not going to attend work because my 123 manager asked me not to.

The next day, I received a call from the 123 HR saying that she has received a feedback mail from ABC manager saying that I have behavioral issues/nonperformance issues/taken unapproved leaves, hence I should not attend office until I'm instructed to. So I really got tensed & asked the HR if my ABC manager has provided any evidence or proof against any of the above mentioned allegations. She said, she received it. I asked her to share with me as I don't feel from any angle that I have done anything wrong. She did not provide me anything.
Later I received an email warning from the 123 HR saying that I have behavioral issues/nonperformance issues/taken unapproved leaves & that mail should be considered as a warning mail. I really really got annoyed & replied back asking for proof and evidence for these allegations as I found it totally false & baseless. I also mentioned in the email that I am mentally too frustrated and stressed because of all the things happening at work & requested them to disregard that bond so that I can resign & move out. Again I did not receive any reply to that.

The next day, I received a call from the 123 HR saying that my bond will be disregarded & I can send the resignation asap so that my F&F settlement money can be processed asap. They had kept my salary on hold because they wanted to pay it as my F&F. I told them that I will not resign since I had mentioned that under mental pressure & I din't really mean I would resign. I am willing to work since I find the job profile interesting & challenging for my professional growth. But they went on calling me & texting me & pressurising me to resign & hand over the ABC company's assets (laptop) to the company asap. I did not agree to resign. I also mentioned that I dont think I have done anything wrong , so I wont resign. If they still feel I should go, then they can fire me with appropriate proofs of my wrong doings (which I was sure, they wouldn't find anything, because I never did anything wrong).
But they are not firing me, nor they provided any evidence against the allegations made.

Since I was banned from going to office, I respected that ban and stayed at home for 3 working days. I thought, maybe they'll update me on joining back but nothing happened. So I decided to resume to office myself & I went to office & realised that my access card to enter office got banned. After investigation from the security, I came to know that my ABC manager has sent an email request to deactivate my access card & that is on hold. I immediately sent an SMS & mail to my ABC manager saying that I'm outside office & my access card is banned. He dint care to reply. Then after a while, I received a call from 123 HR saying that you are banned from going to office that's why they have banned your access card. I told the HR, there is no such email communication from anyone on my 'BAN' period, so I came to office to resume to work. This is how they started forcing me to resign.

I have many proofs and email communications on how unprofessional the 123 HRs are because I had to follow up many times to get my medical insurance. For 4 months, I had to continuosly remind them that I need it at any cost. I also have proofs against my ABC manager on how unsupportive he was whenever I raised concerns. How he ignored my queries. Both ABC manager & 123 manager told me to be prepared for night shifts which wasn't at all discussed during my hiring initially nor was it mentioned in my offer letter. They did not mention anything about working at night. My ABC manager was also against about providing me night shift allowance which I had to fight for 2.5 months. I agreed to work for night shift provided that they provide me night shift allowance/cab/30% hike since I wasn't informed on these timings during my interview sessions. After a lot of fight, they agreed to provide me night shift allowance + cab facility, but they did not agree to provide me 30% hike. They turned the tables around & said that they will decide on the hike after me completing 6 months of employment.
Another point here is, my initial logout timings were 8:30pm and I was not provided a transport for those timings. It was really difficult to ride my bike for 30kms to & fro specially in rainy season where there was heavy traffic & I reached home about 2-2.5 hours late everyday.

So here, I need help as to what I can do? Because I really really dont want to resign as I love my job profile.

Thanks
