Resignation

(Querist) 26 December 2017 This query is : Resolved 
I have resigned in system on dated 11 sep 2017 and as per appointment letter need to serve notice period of 90 days , I fully served the notice period , but meanwhile due to some issues of audit supervisor marked me mail to not accept the resignation and issue me a letter on mail that work till audit conclusion , now as per process / SAP last working day is 8 Dec , and from 9 Dec I have not attend the office , and now I m approaching the HR of the Organization , they said till conclusion of audit report we are not release from service...can employer bound employee post completion of notice period ...merely basis one letter issued on dated 11 Oct post one month from resignation date .

What have been your constraints in not complying with the request of the audit supervisor? Have you informed the Management of your constraints?

you served the notice period then no need to worry, approach a local lawyer and issue a notice to the management.

If you have posted the correct facts in query then;

Per upper para:
You have duly served the notice period (90days) and also upto LWD issued by employer/establishment.
The said communiqué is issued after LWD.
By then if you have already joined next establishment, communicate in writing under proper acknowledgment.

In last line; you have posted that the letter is issued after 1 month of resignation.
That implies within 90days of notice period.
Which part of query is correct; Upper para or last line?

You may also confirm; did employer acknowledge and accept your notice of resignation whatever was it 30 or 90days? Do you have copy of acceptance?
Who is this audit supervisor; internal entity or external?
Has employer issued/supplied any communication on appointment of such auditor to you?

Employer not accepted the resignation , resignation marked in SAP software and as per software last day is 8 Dec and till that date I worked ,audit is internal , resigned marked during audit , supervisor issue one letter nentioned that we are not accepting the resignation due to audit but that letter issued post one month from resignation date

The limited understanding from your posts is;

If employer accepts notice/resignation by said SAP and gives acceptance by way of LWD by SAP and LW is 8th and you have worked upto 8th then you(employee) as per your pot has completed his obligation..
If supervisor has issued letter on 11th then IT is after LWD chosen by employer.....

But not accepted by employer , it's only system generated last working day , now what remedy I will take to get the relieving

To the simple understandable point simple impression has already been shared;
If the employer prefers to communicate and accept and issue via said system then IT is choice of employer.
The acceptance issued by system installed by employer for such matters is a matter of record and such system has issued the reliving date.
The employee as per system has worked till LWD issued by employer thru IT’s system.
The employer-employee relationship is severed by employer per IT’s preferred system and practice.

What type of simple understandable point simple impression were made through earlier 4 irrelevant and vague posts by Mr. Kumar Doab (fake expert) that even from anyone of those posts the querist could not understand anything? It seem, making simple things as complicated is his hobby.

Even in his 5th post he has not been able to provide any solution to the querist, when he asked, "now what remedy I will take to get the relieving?"

NOT ONLY THAT, Mr. Kumar Doab has tried to give an extremely false hope tot he querist by saying, "the employer-employee relationship is severed by employer per IT's preferred system and practice."

PROBABLY Mr. KUMAR DOAB IS NOT AWARE THAT EMPLOYER-EMPLOYEE RELATIONSHIP IS NOT SEVERED BY MACHINES OR THEIR SOFTWARE APPLICATIONS, BUT ONLY BY HR DEPARTMENT BY PRACTICALLY ACCEPTING RESIGNATION AND RELIEVING THE EMPLOYEE PHYSICALLY BY ISSUE OF RESIGNATION ACCEPTANCE LETTER AS WELL AS RELIEVING LETTER.

It is not understood, when Mr. Kumar Doab does not know ABC of the subject matter, why he indulges in to making multiples of posts, merely to play a number game for seeking fun for his disturbed mind.

Irrespective of the audit being statutory or internal audit, no organization prefers to relieve any employee, when audit is going on, as only the concerned employee can appropriately represent the transactions before the audit.

Moreover, if some fraud is detected in his performance later after his resignation, the management cannot afford to struggle hard to take the employee to book after he is relieved on acceptance of his resignation.

If your portion is not very important on the audit aspect, you may request the HR to accept the resignation and relieve you from your duties. SAP/ system record is always subject to correction, if found wrong on verification.
