Sir I have 8 yrs son my husband left us since 3 yrs I have filled case of 125 for my child and domestic violence Case in District Court .before 2 months I came to know form my husbands friend that he left us for a girl with whom he is live in relationships from 3 yrs. I shocked and don't know what to do.she is now under training of PSI and I know each and everything about her but how can I prove that in court. She is from ST. And I m from SC. My husband cheated me and without any fault left us. Our marriage is love marriage and I m alone. But working women. My husband also don't give maintanace of my child. But family Court judge don't take any action against him. Please guide me. I m also a law student of 1 yr.

Obtain services of some detective to gather proofs for his living with another girl.

File execution if he is not paying maintenance.

yOU ENGAGE A DETECTIVE AGEHCY AND GATHER PROOFS AGAINST YOUR HUSBAND. ALSO FILE FOR MAINTENANCE OFYOUR CHILFD FROM YOUR HUSBAND. hE IS LIABLE TO PAY FORTHE UPKEEP OF THE CHILD. UNTIL THE CHILD IS 25YEARS OLD.

no use engaging detective agency. No action is possible against either of them unless they get married.

Husband has to pay maintenance of child even if you are employed.

Nothing less nothing more till the time you have conclusive evidence of marriage of your husband with his girl-friend where he is stated to have been enjoying live-in relation.

Ms. Usha Kapoor under which law a male child or son entitled to get maintenance from his father upto age of 25 years? Why you give wrong advice to innocent people and allow them to move wrong path.
Yes minor son upto age of 18 years is entitled to claim and get maintenance from the father.
As far the other woman in the life of your husband is concerned that gives you valid ground for divorce only if you so desire otherwise it is of no consequence unless you prove his marriage with her or to prove act of cruelty as punishable offence under section 498a IPC for any relief. He's enjoying his life with her after fulfilling his sensual desire with you and left you with a child to look after that's the tragedy of your life. For such person who cheat their lifepartner best punishment is shoe beating in public, in presence of the lover with whom that person lives.

. 4 Till what date is family pension payable?

Ans.

· In case of wife / husband: Up to the date of death or remarriage, whichever is earlier.

· In case of son: Up to attaining 25 years of age.

· In case of daughter (including widowed / divorced daughter): Up to attainment of the age of 25 years or marriage whichever is earlier.

· In case of Physically / Mentally retarded children: Family pension is payable life long.
Anyway if I commit mistakes God fathers like you are there to correct them. Don't worry.Right of divorced wife to claim familypension from her ex husband also you've given wrong legal advice and misguiding people, Except me and P. Venu every body else gave wrong legal advice.Before pointing out your accusing finger at me do some introspection and after correcting yourself thoroughly then teach others.
