Divorce alimony

Hello experts .. me and my husband have been married for 11.5 years now ... I'm not working and v have 5.5 year old daughter .. I am taking divorce coz of mental cruelty and abuse ... And I have been staying with my parents since 6 months .different city 700 km away .. I don't want a divorce but I can't stay under same roof after whatever happened ... My daughter needs her father so I don't want a divorce .. hes asking me to come back or give me divorce if he's very particular about divorce then I better prefer divorce than staying together.
Coming to the main question he's a wealthy man with earnings of 8 to 10 lakhs a month but pays very less taxes ... Business is divided into 5 to 6 firms in my name and in laws name .. business in my name he has the power of attorney.. he drives a Mercedes but in his father's name .. got properties of 20 cr but mostly in in laws name and no residential property in his name ...he might b showing profits of about 6 to 8 lakhs per annum in his name but actually his monthly income is more than that taking into account his parents firms .. though the firms are in his parents name he solely manages them it was just divided for tax purposes ..
My demand is a 2 bhk house worth 2cr fully furnished in joint name of child and me and 1.5lk per month as alimony and fds and insurance for child's future education ... how to get it from him coz I know he's capable of paying much more but on papers his worth is very less

You can file divorce case against him and demand interim maintenance for self and your daughter from him during pendency of the main divorce proceeding as well permanent alimony and maintenance at the time of finalization of the case. Your complete demand can be elaborated in these applications under section 24 25 and 26 of the HMA if you both are Hindus and have married according to Hindu Marriage Act and seeking divorce under this Act.
