I want an expert opinion : The matter relates to Kerala Hindu Family
The father died intestate. The 9 children with mother executed partition deed for the property obtained by succession. In the said partition deed, one member did not sign, even though his name is mentioned in the document. The incident is 20 years back. Now the same want to ratify by accepting the said deed by the non signed member.

Kindly advice me the remedy

Yeah! you all rest of family members unanimously support him to put his signature in family partition deed through ratification even after 20 years of its creation thereby reinviting that person to the family fold such a deed of ratification/partition is valid.

My question is to solve and make him approve and ratify the action. I want the answer for that and not for restraining him from the same. The past action to be ratified and not to restrain the party.

Thank you for the advice. Also let me know, by what procedure the earlier Partition Deed which is already executed before 20 years, can be validated. Can a Ratification is enough or any other methods?

Was the person, who did not sign, provided with his share in the property.? What is the reason that he did not sign?

Unregistered partition deed is not valid in eye of law better you all execute a family settlement deed and get the same registered before sub Registrar office.
