I am a Christian. My mother passed away and owns a flat. I am the only son. My aunty claims that my mother has gifted the property to her and I don't have any right for the property. Kindly suggest the way forward.

Let her produce the valid gift deed.

Or you may need to stake claim of inheritance.

Death certificate, Legal heir certificate/LOA/succession certificate may be required at your location.

Check with O/o Authority under whose jurisdiction property falls.

Sir,

Obtain Legal heir certificate and claim the property first, side by side check with the concerned registrar about the gift deed, because the gift deeds are required to be registered ....

It is the O/o authority that can update the change in mutations in favor of person that appears with a valid deed or claim of inheritance...........

Check with the O/o authority if your aunt has appeared with registered gift deed.

MERELY CLAIMING IS NOT ENOUGH!
ASK YOUR AUNT TO PRODUCE THE GIFT DEED.
Go as per advice of above learned experts.

Apply for mutation on the basis of legal heir certificate, if she has valid gift deed let her come forward with court orders.
