Can Account closed attracts the section 138 of ni Act. Kindly advice on this.

Yes, if you understand the gist of Sec 138 of the N.I. Act and the rulings of the Courts on the said Section, the Section is not only applicable for cheque bounce but also for Stop Payment and Account Closure.

In my opinion, if the cheque is issued after closure of the account, it will also attract Section 420 of the Indian Penal Code.

The academic questions can be discussed in LCI forum.

The present question is academic only without any specific matters. However, it is answered that closure of account and issue of cheque from closed account shall attract S.138 of NI Act.

If blank cheques of accused are misused by complainant then accused may take defence as no legaly enforceable debt and complainant misused blank chequesof old acct which is closed and dues settled. The complainent should prove that legaly enforceable debt was there and still accused issued cheques and then acct closed .kindly note it depends on facts of each case.good luck

As of his chronic disease to make vague multiple posts, irrespective of whether he knows anything about the topic, Mr. Doab has been successful in making 4 more vague posts just with the vain impression as if he could be recognized as an expert by earning tens of scores to run for the top of the hall of fame.

A FAKE EXPERT WITHOUT A REAL IDENTITY, REAL NAME, PHOTO AND LOCATION REMAINS A FAKE EXPERT ONLY.

It is not understood, why he is afraid of posting his real identity in his profile at the LCI. Strange enough, inspite of hundreds of requests, he has openly refused through several threads to appear with his real identity.

I agree with the views of Mr. Adwait Bhonde. But a fact remain unclarified is how a closed account holder issued a cheque, cheque issued is before closure or after closure. Normally bank insists for redepositing unutilized cheque before closure.
