Time limit for issuing chargesheet

(Querist) 14 February 2017 This query is : Resolved
May I know what is the time limit for issuing chargesheet if a person suspended before six months without giving any reason in vigilance case & revoked in two & half months but 6 months passed no chargesheet issued. Please guide me. Thanks
Guest (Expert) 14 February 2017
Normally within three months of the suspension period. Rest depends upon the complexity of the case and the documents/ data to be analysed and the number of witnesses to be questioned during investigation of the case.

In my humble opinion, there is no time limit prescribed by law for filing charge sheet.

Dear Shri Jahangir,

The querist has not asked for charge sheet to be filed in the court of law, but departmental charge sheet to be issued after he was placed under suspension by his office.

For departmental charge sheet there are instructions from DOP&PW as well as the CVC to issue charge sheet within three months, as far as possible,

Even in Criminal Cases where the Punishment Could be up to 3 years if Charge sheet is Not Filed in 60 days and where the Punishment Could be up to 7 years if the charge Sheet is Not filed with in 90 days the Accused could get the Bail.
