Certificates holded up by the employer

i worked as a teacher in one of the private colleges in Kerala.Due to the lack of professionalism and lag in getting salary i decided to resign.My appointment letter says i have to give 3 months notice.But already 2 months salary is pending from the employer.Now employer is asking for 1 month's salary inorder to get back my certificates submitted at the college.I wanted to know 2 things,

1.Is it legal to block my certificates at the college.

2. Will i be able to get my certificates legally without paying 1 month's salRY.,,,,,i have acknowledgement certificate given by the college in receipt of my certificates.

Plz help me...

1. Yes, it is not legal.Ask to return original certificates in crisp condition as these were handed over (unsoiled, un-mutilated etc)

2. Employer has no lien on educational certificates.


Relate with Board affiliation laws e.g; CBSE, State Education Act, Univ. guidelines on the subject, for this matter, notice period and everything.



Ask to supply acknowledgment of notice/final resignation and acceptance, CORRECT FnF statement,salary slips of all months, NOC/NDC, acknowledgment of handover of charge/assets,service certificate, relieving letter, PF number and a/c slips, Gratuity, Form16 as per CORRECT FnF statement, original certificates etc etc...........

2. Holding of certificate is not related with terms of contract.
