Judge has imposed fine...

I am Merchant.
I have criminal matter u/s 420 and 34 pending in court.
My last date was 8th June 2016 but due to back pain I couldn't attend court though my advocate was present, yet judge imposed fine of rs.3000.
Now next date is 11th July 2016 and my advocate said that i will have to pay fine because judge is irated as on that date witness was present and I (accused ) was absent.
I don't have money as I am simple housewife and have no income.
Now my advocate is also not going to come on next date as he is in another court.
What kind of application can I give to reduce the fine amount?
I m very nervous.
Plz help.

Mention the reason as to why you could not attend the hearing and request for the waiver of the fine.

Dear Dilshad,

"I am merchant" and "I am a simple housewife and have no income," are two contradictory statements from your side.

First of all please be clear whether you are merchant or a housewife with no income.

Secondly, you have not mentioned for what act of yours or in collaboration of others case under sec. 420/34 has been filed against you?

In the absence of wanting facts, no suitable advice can be rendered. So, there being no time with you the date being tomorrow, you will have no alternative, either to pay the fine or to request the judge to waive of the fine, provided you produce proof of your illness, as you said. But, there is still a risk of offending the judge more with scope of increase of amount of fine. So, it would be better, if you pay fine before start of hearing.

It is advised, arrange the money and pay the fine. Waiver procedure would be more expensive.

Your statement (in query) are contradictory as observed by expert Mr. P S Dhingra, I fully agree with him.

What for do you need opinion and advise of experts on this platform, when you are already availing services of an able and intelligent lawyer, probably it is free of cost, isn't it?

You have no escape from paying fine imposed by court and fees of your lawyer, if s/he agree to contest.
