Photocopy of unregistered will

(Querist) 17 June 2016 This query is : Resolved
Some people have come forward with a photocopy of an unregistered will (may not be real) said to have been written by my grandmother some 30 years ago. They have now approached the court with a suit for permanent injunction on my inherited and joint family property. Is a suit for injunction maintainable on only a photocopy??

Defend court case with help of lawyer.
KD (Querist) 17 June 2016
My question is whether any body can sue on the basis of photocopy?
Devajyoti Barman (Expert) 17 June 2016
Photocopy of original is secondary and can be admissible in evidnece in certain condition.
In other words photocopy is very hard to be proved if disputed by you.
So engage a alwyer and contest the same on merit.
Kumar Doab (Expert) 17 June 2016
Engage a very able counsel.

Original need to be made available or photocopy has to be proved beyond doubt and circumstances has to be mentioned to the satisfaction of the court, why original is not made available.

Is original not available?
KD (Querist) 18 June 2016
