Filing defamation case against tv channel

(Querist) 14 January 2016 This query is : Resolved
Sir,
I am a senior lady officer working in public transport undertaking. i have been involved in 100 of recruitments in my 30 years of career and worked till today without any blemish. But recently with illmotive some male officers with the help of one retired official telecasted in a private television channel regarding me that I have gathered crores of rupees in the recent recruitment held two years back and I am a very corrupt officer etc without any proof. The media people themeselves told that I am corruptive and misused my official position etc without any proof. This recruitment was held two years back and our department security and vigilance officers were also involved in the recruitment process. They could have investigated regarding corruption at that time. I am mentally tarnished and my image has been spoiled in the public.

Sir please guide me what action I can take

what was outcome of vigilance inquiry?

If the news item is false, you may file the defamation suit. As the preliminary step you may serve a Notice through an advocate.

It appears that you are a public servant. If so, permission from the Competent Authority may required. Please verify.

Sudhir Kumar sir,

There was no vigilance inquiry, not a single complaint regarding corruption during recruitment. The chief security & Vigilance Officer was also one of Selection Committee member. After two years TV Channel has telecasted yesterday that I accumulated crores of rupees in recruitment without any evidence and proof

Request your department to held inquiry and give you clean chit if nothing found against you in the inquiry.

Request your department to permit you to file defamation case.

Hi,
If you really think that you are clean in this case and you have been allegedly framed in this matter and the said TV channel has reported the news on hearsay evidence.. then Go ahead and teach them a lesson.. send a legal notice first mentioning the damage caused by the tv report and defamation, if they don't respond to your notice then file a case.

just initiate the legal proceedings by issuing a a legal notice for defamation as well as by claiming damages..

if you are genuine mean you are deserved to succeed madam.

you said

"The chief security & Vigilance Officer was also one of Selection Committee member."

This is an irregularity in itself and the inquiry is also a farce. Making VO a part of selection committee is itself not advisable and not as per vigilance manual.

SO as far as recruitment is concerned you have not got any clean chit.

Adv Sudheer Kumar has given the correct reply, so u can certainly go for defamation against the said TV channel.

Request your department to conduct an enquiry on the allegations. If a clean chit is given by the E.O., then file a defamation case against the T.V. and also against the officials who have defamed you. If a clean chit is given, then that will become an evidence that you are not corrupt. Your case will also be strengthened. I feel if you yourself file a defamation case against them, the burden of proof lies with you that you are not corrupt official.
