Dear experts, if divorce case is filed by a woman and they have only one child(girl) near about 1 year and both parties claim for child then what is Judement about child from judge and which factors are kept in mind by judges to give child to man and woman? In which circumstances a case will be in favour of man?

Normally a mother gets the custody of young children. The male spouse then gets the visitation rights. Girls are as rule are entrusyed to the care of the mother. Economic difficulties or other problems faced by the mother count for little. If the mother is of the sound mind and not suffering from any chronic contagious infirmity then the mother would be the preferred destination for the infant . Court is also persuaded by the best interests of the child as to where the child can get adequate food, shelter, education and affection. The cases are decided on case by case basis The custody of a one year girl child would in normal circumstances is always entrusted to the mother.
