Xerox copy of agreement - is it valid.

(Querist) 12 July 2015 This query is : Resolved 
A compromise agreement was made on a 5 rupee stamp paper for a particular one suit & was signed both by the plaintiff & defendant, with 2 signatures of witness. It was not registered, not even notarized. Now if one wants to rely/depend only on the said compromise agreement in another suit, then he should produce only the original copy of the compromise agreement in the court, or he can produce simply a xerox copy. Does a xerox copy is valid in a Court?

original document. whether e.5/ stamp paper valid when it was executed is another valid question to be checked, if not the document might be defective but certainly not seriously bad in law as it could be regularized by new registration by paying adequate fees with necessary fines chargeable by the state govt concerned under regularization procedure AVAILABLE.
if not thereyou can move the the registrar's court that would issue suitable order .

Compromise agreements entered outside the court will not be valid in the court. You have to type the compromise on the ledger paper and you both parties should present at the time of compromise. (in the alternative your counsels can also be present on behalf of the parties).

The document need to be proved in the court through original and or otherwise also.

The validity of the document has to be proved on merits.
