Factories act 1948

(Querist) 17 June 2015 This query is : Resolved
Respected Sir,
As per section Factories Act 1948
1. Is a supervisory staff is worker?
2. Is a manager is worker?
3. For whom it applies?
4. Whether weekly holidays and compensatory holidays of managers and supervisors will be guided by section 52 and section 53 of Factories Act 1948?
5. In a factory management make an order as below:
“As per section 53 of Factories Act 1948 in liew off shall be allowed, within the month in which the holidays were due to him or within the two months immediately following that month.”

Can above order exempting the factory from the provision of section 52?

Can as per above order any worker working for more than ten days consecutively without a holiday for a whole day?

Your valuable advice is expected sir.

any supervisor is considered managerial staff, definitely not a worker,

compensatory off provision exempts the provision, that you can get compensatory off under sec 53.
