No objection certificate from lawyer.

Dear Sirs,

I have been fighting a corruption case (unfortunately).At the time of bail,we engaged a junior lawyer and the case has yet to come for framing of charges.

While grateful to him for his services rendered,i intend now to use the services of an expert lawyer in PCA cases since my case is serious.

I was told that i should get a NOC from my earlier lawyer.While i have paid all dues to him,still he has been delaying the issue of NOC for almost 3 months now.Kindly advise what should be done in this case...?

First you could send a Registered Letter to your Old Advocate Explaining About Dues paid and Request Him to Issue the Change of Vakalat.If No reply Your New Advocate Could File His Vakalat basing on this Letter sent in Court.If your New Advocate is Co Operative he could do this with out even sending this Regd Letter Orally Explaining about the Delay Of 3 Months in Court.Just Proceed.This would be the Practical Solution.You Need Not Delay Your Case if Change of Vakalat Not Signed by the Old Advocate.NOC is just the Consent of the Previous Advocate to Change the Advocate it could be Signed in New Vakalat Or if he giives a Letter also it could be enclosed to the New Advocate's Vakalat.No Doubt your New Advocate Could File his Vakalat Explaining the Court about the No response from the Previous Advocate.

Dear Mr. Velmurugan,

If you are requesting him for a separate NOC you will never get it and that is not the procedure.

In fact, you have to give a fresh Vakalatnama to an Advocate whom you intend to appoint, in that Vakalatnama, your old lawyer will endorse his NOC. Thereafter your new lawyer will file the Vakalatnama. That's it.

Generally lawyers does not give NOC easily. You can send registered letter regarding withdrawing the services and give fresh Vakalatnama to new lawyer.
