About claim under m v act

(Querist) 09 January 2015 This query is : Resolved 
a person has purchase a commercial vehicle from another person.And transfer the ownership but he has not transferred vehicle's insurance from 1st owner afterthat that vehicle has met with accident.then bywhat way he get claim from insurence company.
is there any case laws or any guideline.

Along with the RC Book and Insurance Papers Original meet the concerned Insurance Authorities.They would Insist for an Affidavit and Signature of the First Owner would be Required in Transfer Forms.Discuss and Proceed as advised and Required by the Insurance Officer.

The Insurance Company may reject the claim as the policy is not in the name of the owner / owner of the vehicle has changed.

As soon as the ownership of any vehicle is transferred and confirmed by RTO, The new owner is entitled to get all the benefits including insurance.If insurance company refuse to settle the claim then file complaint before consumer forum.
