Medical certificate

Dear Sir ,

I want to know when should we provide Medical Certificate when we take sick leave . My office is asking me to produce mandatory Medical Certificate even for taking 1 day Sick leave. Kindly Let me know in terms of Section if anything like this is Mandatory . I work in an MNC company . Please give me a Solution ASAP

Refer to the enactments that are applicable to the establishment e.g. (Name of the state ) Shops and Commercial Establishment Act that shall govern the service conditions of employees working in the establishment....... and leave policy..... and standing orders(certified/model) that outlines the leave policy, and then download and refer to the leave policy drafted by your company and related.....

The leave policy can provide superior benefits than as provided for in enactment applicable to establishment but can't be inferior....

Usually for one day sick leave medical certificate is not asked for and it is duly stated in leave policy the medical certificate is required in case the leave is for.....=>days.....

If it is duly stated that medical certificate is required for say>3days than no employee has to provide it for sick leave of 1day....


The employee can cite from leave policy....

Moreover at times employee due to certain reasons e.g. OT /Night shift/overstreched meeting/long tours...etc may feel 'Indisposed' and may submit sick leave application as feelings indisposed....which may require rest and no medical treatment with medicines or a simple massage followed by rest may do...

The employees that do not form unions/IC/Guild/Works Committee....usually suffer from arbitrary decisions and tantrums of bosses....

Explain to leave sanctioning authority or escalate...but remain gentle and amiable..
If you were sick then there is no harm in getting examined by the doctor and submitting copy of Rx and advice for rest.....

Probably, you belong to the Exectutive/ managerial class of employees. If so, you may have to refer to the conditions of grant of sick leave in the prescribed leave rules of your own organization. MNCs have their own leave rules.

Whether sick leave was claimed after availing all other leaves?

Whether there has been custom of using sick leave as method of availing leave meant for any other purpose?

This is local custom drawn out due to circumstances, you should abide by the local rule to observe discipline. No harm in submitting certificate if any one was actually sick.

I want to put down papers in my Company but my notice period is 2 months . I am not keeping well . Can I Serve 1 month and for the 2 month can I produce medical certificate to avoid working the second month . Kindly reply at the earliest.
