it appears agreement between builder and first owner is not stamped and registered . you dont have clear and marketable title to the property you ought not to have purchased the said flat . you should have requested seller to pay stamp duty on said flat .

if you seek to pay now heavy penalty would be levied . wait for amensty scheme from state Govt

Thank you for the help...but i am selling my flat..so i cant wait for amensty...the purchaser is taking a bank loan from HDFC and the bank is asking to clear the Stamp duty...Also i dont have to worry about the charges and penalty because first owner had already deposited 3 lakhs with society for the pending stamp duty carges...

agreement should be registered, then no need to worry, just get certified copy. no need to pay any stamp duty.
