(Querist) 11 September 2014 This query is : Resolved
This is reg my consumer complaint..distrct forum rejected complaint based on CMP of OP. I appealed in state commission, after 2 hearings before registrar, the Resp/OP submitted a memo requesting to post it before Commission on 26.08.14...on 25.08.2014 i filed a memo seeking for alternate date as i will be out of station on 26.08 ..but registry did not number it in SR and and i didnt appoint advocate to represent.when i returned on 05.09.14 and looked at diary...it was recorded that impunged order of DCDRF perused and ORDERS ON APPEAL BY 17.09.14 with this background:

my queries are

1. Can i file another memo now seeking for a chance that i may please be heard as appellant...

1A. Can i file a petition for reopening the appeal for my appearance...

2. or can i file my arguments in appeal in written form (say written arguments) so that i will be considered while passing orders...

3.any other legal way to achieve my objective of atleast my points to be heard by the commission before passing orders...

thanks regards

you should have appointed an advocate if you could not remain personally present . since case is already posted for orders you wont be granted any hearing now

1) Yes, you can file a memo for hearing your side argument or to reopen the case to have your counter and arguments.
2)You can file your written arguments too.
3) If you think that if any vital issue has bypassed without your knowledge during the previous hearing in your absence, you may take up the matter by filing a petition/memo to provide you a chance to record your objection or your side justification as a reply to that.
