Property division

(Querist) 07 September 2014 This query is : Resolved
Sir

My grandfather died without making Will. He has 4 sons and 1 daughter. Now only 1 son and 1 daughter is alive. My father died. I am the only son of my mother and my stepmother has 1 daughter and 1 son. The marriage is not legal, it happened when my mother was alive. Stepmother is alive. How my father's share will be divided or how my grandfather's share will be divided. My other uncles and aunt (married) also have kids.

on demise of your grand father each legal heir had 1/5th share in his self acquired property . on your father demise his 1/5th share will devolve on you and siblings from second marriage

The share of your father shall be divided among the siblings of your father means your step=mother shall not get an share thereto and all other shall get equal share.
