In civil case I am defendant filed petition to dismiss the suit on ground of non joinder of necessary party,but the court section returned the petition saying how this petition is maintainable,pl
advice what I should do in resubmitting the same.

This issue is considered after the conclusion of trial, not now.

Court is right.

court can not dismiss the suit in preliminary stage.Take the plea of non joinder of necessary party in written statement and court will frame issue and decide it after completion of trial.
