Sir,
We shifted in a residential complex around 7 years back and a transformer was provided by the builder of 630 KVA and was working ok till 6 months back.
Around six months back the transformer got burnt and was changed by the Electricity department with a new 630 KVA Transformer.
Today a notice has been served to us by the elctricity department that the burnt Transformer removed from our premises was actually of 400KVA and the difference of 3lac(cost diff of 630KVA and 400KVA) is charged on us.
On meeting the builder and asking him to make the payment since he had provided the low rated i.e 400KVA against 630 KVA transformer when we had taken possession of the building has been of no use as he is adamant that he had provided a 630 KVA transformer during handing possession of building.
Kindly help us legaly as per rights available to us.

in rely to the notice mention that transformer was provided by builder . enclose copy of possession letter received from builder wherein it is mentioned that 630 KVA transfomer was provided .

also issue legal notice to builder . move consumer forum against the builder to recover the amount claimed by electricity dept

The builder has provided a NOC from the elctricity safety department which says" Due to staff not available the inspection of transformer could not be carried out hence on request of builder an NOC for 630 KVA Transformer is hereby given"

On the basis of notice received from Electricity Department send notice to builder and file consumer complaint.
