Qs on attendance and withdrawal of ia

(Querist) 05 July 2014 This query is : Resolved
Hi, couple of questions:

(1) I work in one city while my wife filed DVC in another city. The magistrate keeps asking me to attend despite telling him that I work in far away city and it's hard for me to attend. Every time I'm asked to pay penalty for not attending.
Is it compulsory to attend every date in DVC? How can I avoid attending? I'd like to attend only when my presence is necessary.

(2) HC gave an order to magistrate to complete the DVC case in 3 months. But the magistrate is giving dates every 2 weeks or so. I don't think he's interested in finishing in 3 months. What action can I take if he continues to delay the case?

(3) I filed an IA in my divorce case to get her passport details. Now I no longer need them. How can I withdraw this IA ?

Thanks

make application for exemption until further orders . your lawyer can attend on every date .

if however HC has directed time bound disposal magistrate may require your presence for cross examination of complainant and for recording your evidence .

if DV is not disposed in 3 months move HC again for extension of time . courts are over burdened not possible to dispose cases in 3 months

you can apply to court to with draw your IA

please dont post academic queries . experts have taken unanimous decision not to reply to academic queries . i only replied to your query because yesterday you had mentioned you are facing DV/ divorce cases and that you need guidance from experts

Thanks Ajay.
Yes, of course I am facing DVC case and many other matrimonial related cases. And all my Qs are related to these only.
I don't know why you feel I am wasting your time with unnecessary Qs. I at the least have no time to ask academic queries.
ajay sethi (Expert) 05 July 2014
i am merely responding to Mr barman comments regarding academic queries being raised by you daily
Amit (Querist) 05 July 2014
Thanks again Ajay.
Probably Barman has mistaken me for someone else.
The last question I asked was 6 days ago and before that was 2 months ago.
Amit is pretty common name. I wouldn't hold it against Barman.

Rest assured, I am not a law student. I am a litigant and I have no interest in asking academic queries or even knowing about law. I am only asking bcos I need to know for my cases.

As I said, I live in another city and it's hard for me to get hold of my advocate (in my native place) sometimes. So I rely on these forums and I usually get good response from the experts.
