Credit card - repayment

I had a credit card in Kolkata. The bank had verbally assured for a settlement of which I had paid the first instalment in December, 2010. I did not receive any document regarding the settlement. After that I had left Kolkata.

The banks have filed case u/s 420 etc. of which I was not aware till date. I received a call recently saying they are calling from Delhi Police and there are cases pending against me. They are saying they have sent court notices to my Kolkata address. The address in the bank records was not the place I was residing. The person who had come to market the credit card had given the address so that the credit card application is processed successfully and he could meet his target.

I have not received any court notice from the bank till date.

I would like to know what steps I can take. I would also like to know if a bank can proceed with recovery of credit card due after 3years.

Please help me with the details.

Normally such issues are settled by banks out of court and notices are sent to the last known address as per records. You can take up with the Head office of the bank and apprise the matter for closure of credit card dues.

after 3 years claim is barred by limitation . bank cannot file civil suit for recovery unless you have acknowledged your liabilty to make payment .

as far as criminal case filed under section 420 IPC is concerned engage a local lawyer and fight case on merits

Kindly note that file like yours are passed on to recovery agents and they really play pranks on customers by calling them and telling them that they are calling from Delhi police or from the court and that a warrant has been issued and they shall face arrest. I have come across such incidents often from people. Kindly ask them the case number and in which court it has been registered and then get it verfied by a lawyer.

The callers are for sure the recovery agents impersonating as Police/Court officials.


Record all calls and let your lawyer take over the matter for you.
