Confused

Dear Members,

Our head office is located at Mumbai and having branches accross many cities in India.

Now we are planning employees leave but confused how to design because every states having their own Shop & Establishment Act hence, number of days differ.

Since our head office is loacted in Mumbai, can we design employees leave for other branches as per Bombay Shop & Establishment Act.

Confused, please assist me??

NO you can not.

You certainly have to ensure that provisions of the leave are in line with each state where you have an operation.

The provisions of the leave policy can be superior but not at all inferior to enactments applicable to the establishment.

Now consult your Labor Law Consultant/Service Lawyer..................

HR/Admin/IR/Personnel must not meddle into legal issues even if employer wants it.

Any hitch in hiring services of some expert to frame a uniform leave policy for employees all over India by taking care of of establishment regulation of all concerned states also?

Hire the services of some expert lawyer dealing in labor laws, try to design leave rules suitable for the state or better than all states in which operations are being carried.

You can definitely settle common service rules, however, the rules of a particular state wherein such employee is employed, should not be having any detrimental condition for the employee concerned.
