Fing of i.a petition

In civil case I have to file I.A application but every time I try to give notice/copy of the petition the opp. advocate does not appear in court ,
now how to proceed.

if the advocate does not appear then the I.A should be heard ex parte.

You file petition in to Court along with a copy of the same in order to serve through court by making endorsement to that effect.

I agree with Ms. Saleema Kabeer, Advocate, give an extra copy of application (IA) to the Court for the opposite party, whether the party collects or not it is not your baby.
The IA may be filed on the date of hearing, otherwise the Court will issue notice of the IA to non-applicant.

If you file a IA the court will order notice to the otherside. You can also take private notice.

After the service of notice to the otherside the court will proceed further.

If the Advocate of the other side is not willing to accept the notice, a copy may be submitted to the court itself or with the permission of the court, private notice can be given to the party directly.
