Wrong date of birth on passport

Guest (Querist) 04 June 2014 This query is : Resolved
Respected Experts,
A person applied for passport and got the same but Date of Birth was wrongly mentioned on it. He was negligent and didn't noticed it.
Then after the expiry he again applied for renewal of passport and got the same with old date of birth which was wrong.
Obviously the passport holder is extremely negligent.
But is there any legal remedy available for him to get corrected the date of birth on passport. If it is available then in which form.
Your valuable advise is solicited.
Dr J C Vashista (Expert) 04 June 2014
The negligent person holding passport has to suffer as the answer is available in your post itself inter alia that "Obviously the passport holder is extremely negligent"
File a suit for declaration in civil court for correction of date of birth.
Engage a local lawyer to take on the negiigent person's case properly and professionally.

Consult the passport office for rectification of the error as per their procedure.

If it was due to the mistake of passport office it can be corrected by them.

Negligence may create problem for such person but even then he has no other remedy but to approach passport office for the correction.

How can you say that DOB entered wrongly in pass port? Do you have the copy of original pass port application? As you say that the person is negligent, how can you attribute the error on Pass Port Authority if you do not have a copy of application?
If you have proof that the error happened in the processing of Pass Port Office, you/your client can definitely meet the Passport Officer, submit the evidence (that the error crept at Pass Port Office) and request them to rectify the same.

The information supplied by the querist is deemed as correct unless the same is found patently wrong on its face and all suggestions are provided accordingly.

I agree with the experts opinion, more so of Mr. Malipeddi Jagga Rao. Personally call on the passport office, meet the officer, explain the problem, get it clarified if it can be solved locally or you may have to obtain a declaration by court of law through an order on a declaratory suit filed declaring your correct date of birth.
