attempt to rape and murder

(Querist) 27 May 2014 This query is : Resolved
Two persons attemted to rape my wife but when my family members came to protect her they alongwith some other persons from their family attacked on our whole family and which resulted serius injuries to all my family members.
The police persons have registered wrong FIR under simple sections of fighting in between two families for the purpose of protecting the criminals.
The police has denied to register the case of rape attempt and no action is taken in more than a month time.
All of my family members were admitted in hospital due to injury and one of them in ICU.
Please suggest what we should do when police is not registering the case of attempt to rape and openly supporting to the criminals.

Dear Mr. Supreet Singh,

1. The police may not have added s. 511 I.P.C. as for alleging an offence of an attempt to rape due to lack of some investigation.

2. If they do not, do not worry. During the course of the trial if you all bring out this relevant fact during your examination in chief then the court on its own can add s. 511 to be read in the F.I.R.

Meet the higher police officials in person and also through registered representations and if no fruitful result do come, file a criminal complaint under section 200 of Criminal Procedure Code before the area magistrate with the help of a lawyer.

Agreed with the opinion of Makkad Sir. That is the only way, to solve your problem.
T. Kalaiselvan, Advocate (Expert) 31 May 2014
agreed, the remedy available before you is to approach the higher police officials, at the same time, if you donot get any relief from the higher police officer, you may pass the message to the press-media, which will expose all those corrupt police and you may find the police running behind you to solve the issue or you may approach the court directly with a private complaint.
