Security deposit - rent

Hi Team,

I am from Pune was staying in a house whose agreement got over on 14Feb2014. The agreement was notarized for 11 months. Due to deficiency of the Completion Certificate - building. We have to leave the room in in short notice of verbal expression. The owner doesn't intimate by himself. nor 1 month notification from him. And we left the room on 1 march 2014. After leaving the room the settlement was pending. He was out of station. So we sent SMS and confirmed that we have vacated the room. 30 days getting over. Now he finds various reasons like painting, Half month rent, etc to adjust the whole security deposit amount. This kind of adhoc requirement to owner [ completion certificate ] had lead us to bear brokerage fees, logistic, extra deposit to get immediate shelter.

Please suggest us for the same.

based on your rent agreement with the owner of the property, you can send a legal notice claiming

1.) the relocation costs and inconvenience you are put to, and

2.) demand the one month rent for notice period which he has not served

3.)demand immediate settlement of security deposit made by you with him .

You have stated that your agreement stands terminated on 14 Feb 2014 but you have vacated the house on 01Mar 2014, therefore you are liable to pay the rent for the period you overstayed. The painting charges have to be borne by you for having used the house property all the while during your tenancy. The broker charges, logistic and extra deposit for immediate shelter is not the problem of the house owner and as per agreement, one month period to settle the security deposit will commence from the date of actual vacation of the house property,therefore, you can initiate any legal action against the owner only after completion of one month period from the date of you vacating the house.
