Dear Experts

I am cheated by two companies. one is my own bank and other is that company with which i have my demat account.

I issue a cheque to India Infoline Ltd. (IIL) of Rs.5000/- to give credit to my Demat account on 09/07/2009 from my saving account in Axis Bank. The said cheque was passed from my SB account on 11/07/2009 and the amount was debited. But IIL people are saying that they not received the credit.

now what should i do?

REGARDING THE CHEQUE PAYMENT KINDLY NOTE THAT.
1.YOU HAVE YOUR S.B.ACCOUNT WITH AXIS BANK AND YOU HAVE MADE PAYMENT BY CHEQUE TO THE OTHER CO.HAVING DEMAT ACCOUNT.
2.CHEQUE PASSED FROM YOUR SB.ACCOUNT BUT THE OTHER CO.HAS NOT RECEIVED THE CREDIT.
3.YOU MAY FILE A COMPLAINT AT DIST CONSUMER COURT FOR DEFICIENCY IN SERVICE AND FILE COMPLAINT AGAINST BOTH YOUR BANK AND THE OTHR COMPANY.
4.NOTICE WILL BE ISSUED AND BOTH THE RESPONDENTS HAVE TO FILE REPLY.
5 COURT WILL GO THROUGH ALL DETAILS AND THE APPROPRIATE ORDER WILL BE PASSED .
6.YOU CAN GET COMPENSATION FOR DEFICIENCY IN SERVICE ,COST AND COMPENSATION FOR MENTAL TORTURE HARASSMENT AND FOR LEGAL AND OTHER EXPENSES.
7YOU MAY FILE A CIVIL SUIT ALSO BUT YOU HAVE TO AFFIX STAMPS .IT WILL COST YOU MORE.HENCE IT IS ADVISIBLE TO FILE COMPLAINT WITH SUPPORTING AFFIDAVIT AND LIST OF DOCUMENTS.YOUR EXPENSES WILL BE LESS AND YOU WILL GOOD RESULTS AS DESIRED BY YOU IN SHORT TIME.

The said cheque was passed from your SB account and the amount was debited but the other co. has not received the credit yet. You may file a complaint in the consumer court for deficiency is service by the bank.

Consumer Court is the correct Forum to pass necessary orders ! Civil Suit not required and it is with Court Fee!

This is repeated quarry. You have not been cheated rather a correction is required which can be made by your personal efforts rather by litigation. Go to bank and through vouchers or entry make enquiry in which account the credit has been made. It might be wrongful but not cheating as alleged by you.

even I would suggest, make a personal effort to resolve the matter by meeting the officials of the bank and the company.

its better to resolve the matter amicably....if they dont oblige then move into consumer litigation.
