(Querist) 21 October 2009 This query is : Resolved
A car which has proper insurance coverage was damaged due to the fall of tree over it by accident. But the inusrer refuses to the claim for the damages caused to the car. On what basis the coverage of insurance for a car is decided? what are the conditions to be satisfied to claim the damages?
adv. rajeev ( rajoo ) (Expert) 21 October 2009
You had to pay the extra premiumto cover the natural calamities, unless it is covered insurance co., will repudiate the claim.
is itcomprehensive policy ?
proper coverage means you have covered it so you are entittle for the damages. You issue a notice to the company to settle the claim otherwise file a complaint before the consumer forum.

The coverage of insurance for a car is decided by the policy agreement if it covers damage by the natural calamities then you are entitle for such claim. All the terms & conditions are mentioned is the policy to claim the damages.
A.P.Manoranjan (Expert) 24 October 2009
If the policy covers such calamities, it is better to send a legal notice first to the insurance company for performance of the contract. If after the date no reply is received, approach consumer court for redressal.
