Land related matters

Dear Sir,

My parent has constructed a house in 1993 on land within 10 KM outside the jurisdiction of municipal .
Since then population of area and number of houses grown hence the value of property increased. When my parent had constructed building only 8 to 10 family were in colony so the problem of Road were not at all but now the people are constructing the house by covering all the land and not caring about how the other people will exit and come to main road.

You all requested if you have any suggestion in this regard then pls. mention Professional advocate are also invited

Dear JHA Ji,
As per your query the land is under the jurisdiction of Municipality or Gram Panchayat,and there is no any plan or diagram of transport way/road so it is necessary to first make a society to look after all the matter of new setup colony, under this society you take and or move all coming problem of colony.

Everybody can construct land on the designated land no matter whether the approach land caters to them or not.
Only if the road is encroached you can go to Municipality and ultimately to court.

Mean! There is not any alternate way to get the land for transportation legally,

The subsisting easement rights, if any, could be enforced. However, separate arrangements would have to be worked out for anything more.
