Time limit for agreement to sell as per limits law

(Querist) 02 October 2013 This query is : Resolved
I had entered into an Agreement to Sell on 04.10.2010. I believe its limit is 3 years. when does it expire, on 03.10.2013 or 04.10.2013. Can it be extended and for how many days.
ajay sethi (Expert) 02 October 2013
it depends upon consent of parties . if both want to extend period they can do so .
R.K Nanda (Expert) 02 October 2013
it can be extended if both parties agree.
Jagdish Kumar Sharma (Querist) 02 October 2013
Sir,

1. I wish to know specifically when does it expire on 3.10.2013 at 2400 hrs or court closing hrs or on 04.10.2013 at 2400 hrs or Court closing hrs. Date of signing of ATS (Agreement to Sell) by both the parties was 04.10.2010. at 1430 hrs.

2. Is this expiry date linked with Date of signing of the ATS or the date of the final Performance fixed in the ATS.

Thanx to all.
J K Agrawal (Expert) 02 October 2013
it expires on 05-10-2013 at closing hours of Court.

If not agreed upon by parties in writing the extension of time is not possible.

But there are so many ifs and buts in calculation of starting point of time it is advisable to consult an expert of the field.
Rajendra K Goyal (Expert) 02 October 2013
Respectfully differ a bit with the expert, if the agreement is valid for 3 years, executed on 04.10.2010 it would expire on 03.10.2013 (when no provisions in the agreement for grace days).
J K Agrawal (Expert) 02 October 2013
Mr Rajendra is correct. I made a fatal mistake in my reply.
Raj Kumar Makkad (Expert) 02 October 2013
I also endorse the advice of Rajender ji. The agreement can be got extended by both parties with mutual consent for the mutually agreed date/period.
