(Querist) 12 September 2013 This query is : Resolved
Fact of the Case :- That A, B, C are brother A is separated from B & C in 1995
and in year 2000 the B & C had purchased the property in their name and after that C had relinquished his share in that property.
Now in year 2013 the plaintiff A had filed suit for Permanent Injunction and for B should not create any third party interest
That in Civil suit the Plaintiff had registered the plaint and one affidavit at Sub-Registrar Office and in civil suit also filed an Temporary Injunction application
Now the matter is fixed for order on Exh. 5 (Application of Temporary Injunction)
My query is that whether I can sale the suit property if the T I is rejected
What is the effect if lis – pendens
What is the time limit of lis – pendens
What is the effect of Lis Pendense notice and Temporary Injunction Applciation and distinction.

My client need money urgently and therefore he is in mood to sale the property as early as possible pls guide me.

Thank u

if there is no stay granted you can sell your property but any purchaser would hesitate to do so on account of pending litigation . you wont get the market price but will have to settle at a discount
