Pl give full facts of the case and at which court the case is lost.

1) you can appeal to higher court.

2) The landlord will have to apply for copy of the Judgement and than will have to file execution petition.

So watch daily when this is filed, appear and take objection for execution.

3) File immediately third party objections for execution.

Even far execution the case will go on and on.

Take from him in writing on a paper that he has received vacant possession of the flat in presence of witnesses.
Other option is to follow the above advice of ADVOCATE DEFENSE and wait for the execution proceedings.

The Surendranagar High court judegement has come in Dec'12
Court has given time to vacante by Feb'13

we have asked extra time to vacate the flat time given by land lord till May'13

now we are vacanting the flat what would i have to take in writing so in future the land lord cannot make any claims against me.

When you had to vacate till 13th May why you have posted the query on 22nd May.

What you were doing in between.

Seems you have given up before the fight. Even pan tappery KIOSK go upto SC to maintain possession.

You still have option to go 1) SC on point of law and 2) Let third party file objection who are not bound by any judgement.

Your due date has already expired and I do hope that you might have surrendered as desired.
