Complaint against a builder

Sir,I am staying at Mumbai, I have to file a complaint against a builder who has constructed a builder from plinth up to 7floors and the building has been completed without obtaining C.C which i have confirmed by RTI from the authorities, the authorities have given me in writing that builder has not been issued nor the builder has applied for any CC. KIndly can you draft a strong complaint against the builder and the architect please

Dear anita,

Any form of legal proceeding will begin with the sending of a legal notice and then proceeding to file a suit or complaint in the court of law but in both these cases you will have to supply to me details about the about the property. Please get in touch.

Going through your query i could not find your cause of action against the builder.If builder has built flouting laws of sanction plans,either authorities concerned or bookers of flats can take action or a PIL may lie directing Government to take action.

So You need to tell some more facts to enable Adv. Elgin Matt John who is advertizing here to attract professional misconduct.

Mr prabhakar, If there is an issue pertianing to the use names and details of lawyers in replies then I can assure the users of this forum that my details will not be appearing henceforth in forum discussions.I am not aware whether this constitutes as advertising but nevertheless as this is causing inconvenience to members details will not be appearing henceforth. to enable builder to commence construction he needs commencement certificate from BMC . his plans have to be sanctioned . if pursuance to your RTI application it has been mentioned in writing that building is unauthroised then BMC can demlish the building .

if BMC does not take action you cna move court for necessary reliefs

A police complaint can also be filed against such builder with the order of demolition by BMC. Serve a legal notice to BMC and then file a writ against it for not complying with its lawful duty.
