Transfer of rti application u/s 6(3)(ii) of rti act

Good Evening Experts
Normally as and when an RTI application received by a Public Authority, the receiving authority has to transfer application within five days on receipt of application as required u/s 6(3)(ii) of the Act.
However, in certain cases, the Receiving public authority transfers application (after lapse of five days)to the Public Authority concerned after making a correspondence to other office or zonal office and as the functions of the CPIO/SPIO as the case may be is a quasi-judicial one and has to take decision by himself for furnishing required information.

It is therefore, requested to kindly clarify whether such internal correspondence is permissible under the provisions pf the Central Act prior to transferring RTI application and if not, whether first appeal u/s 19(1) of the Act is enertainable before the Appellate Authority or the final decision of the CPIO/SPIO has to be awaited.

Any appeal is entertainable after 30 days. You have to file fresh application for addistional information.

Definitely SPIO can take help of other branches of the same department to collect the information and even to send to the applicant.

yes SPIO can take help but the right information will reach after stipulated time also some times
