Land registration

(Querist) 12 February 2013 This query is : Resolved
Sir,

I m in process of purchasing an agriculture land near Nagpur(Maharashtra). The seller has the registry papers on her name and she got this property from her husband (died) and her husband got this property from his mother through her will.

Now one of the nephew of her husband sent notice to that lady(owner) not to sale that land.

Please suggest what should i do? can i purchase that land?

Pls suggest

Engage a Nagpur Lawyer to publish News Papers Notice asking Objection.; As nephew sent Notice, send it to him also , asking him to give in writing his Objection with Document he may have. Let your Local Advocate check with 7/12 Extract, contents of WILL, relationship.
If that Lady's MIL purchased this property, being self acquired, you can purchase it.

It is a pity you have not indicated any relevant dates/years like when did the lady's mother in law die; when did her husband die.

You also have to indicate whether the WILL left by the mother-in-law was probated before the property was mutated in the name of the lady's husband. (Whether the lady has any son/daughter?)

These are the information that are necessary before one can give an answer to your query.
