Whether fir can be lodged simulatneously with the criminal compliant?

(Querist) 20 January 2013 This query is : Resolved
Sir, In cognizable offence, if the complainant has file the criminal complaint under section 190 read with section 200 of Crpc, Whether he can lodged the FIR to the concerned Police station ?

Whether its essential that he should report the matter to the magistrate after lodging of FIR who has taken the cognizance of the offence??
Devajyoti Barman (Expert) 20 January 2013
Yes he can do so and both the cases can proceed simultaneously.
Raj Kumar Makkad (Expert) 20 January 2013
He cannot resort two forums at the same time if the facts of the complaint made at both places is same.
Arvind Singh Chauhan (Expert) 21 January 2013
After filing complaint in court he can not do so as opined by Raj Sir, But if FIR has been lodged and no action was taken he can file complaint in court.

If during the proceeding of complaint in court police send the charge sheet on the FIR previously registered. The complaint merge in State case under Section 210.
Raj Kumar Makkad (Expert) 21 January 2013
Yes, I endorse what ever arvind has stated.
