Summary procedure

Dear member's

I wanted to know that whether court fees is leviable on summary suits under order 37 of CPC. if "NO" then what is the provision in the court fees act.

To be more specific i wanted to file a summary suit in chennai, can any one help me or guide me in this regard.

Your immediate opinion and response will be highly appreciated.

yes court fees are payable depending upon the amount sought to be recovered by you .

you must come within ambit of order37 rule 2 . in ther words suit must be in respect of written contract or bills of exchange , cheque etc . contact a local lawyer

to claim any relief/s from court u will have to pay court fees. nothing is free in courts.

THE BEST WAY IS TO VISIT A LAW BOOK SHOP AND BUY A COURT FEES ACT OF THE CONCERNED STATE TO ASCERTAIN THE COURT FEES PAYABLE FOR THE KIND OF SUIT TO BE FILED IF ONE DOES NOT RELY
HIS LAWYER.

ONE CAN FILE SUITS WITHOUT PAYING COURT FEES ON PROVING HIMSELF TO BE INDIGENT.
