(Querist) 14 October 2012 This query is : Resolved
if a deed writer is writing a sale deed ,can the same deed writer signature as witness in that same sale deed at the time of its execution in registrar office.i there any section and rules where it is specified who can be witness

deed writer himself is a witness to an extent that the document was written by him.

to further prove the execution, you need to support the case with the testimony of attesting witnesses.

Yes scribe can be a witness to sale deed; no bar in law.Any body competent to enter into any contract can be a witness.I mean he should be major and of sound mind and should witness out of his own will about facts in his personal knowing.

Dear Client,

Yes! he can be a potential witness even if he is a deed/document writer.

Any reason for simply seeking reply to an academic type of general question without making a mention of some real problem?

Did you have any problem and the reason with the deed writer to be the witness of the deed?

in a sale deed the seller was fooled by the deed writer and A in which the seller went to registry office knowing that he is going to sell the property to A but instead deed writer in collusion with A ,KEEPING THE SELLER IN DARK let the land sold to a third person.inthat sale deed deed writer himself is an attesting witness and other witness is perhaps a fake witness with no address and fathers name.is it possible to cancel sale deed now?

Very often authors here do not put facts straight asking what to do in that situation.
No surprise even if you did so.

The matter now you want to discuss relates to fraud for which a suit of cancellation would lie with in three years from the date of disclosure of fraud.

Still facts stated by you are not sufficient to guide you any more.
