Dear Sirs,
I am a secretary of our society in mumbai having 21 members. During MARCH 2011, one member has sold his flat and submitted sale docuements to the society along with a cheque of Rs.20000/- by the transferor and another cheque of Rs.20000/- by transferee towards transfer premium and requested the society to transfer the flat in the name of buyer. The procedure has been completed smoothly. Now during JUNE 2012, the transferee has written a letter to society claiming a refund of Rs.7500/- stating that he has paid extra additional premiun for transfer i.e. he has paid Rs.20000/- in spite of his share of Rs.12500/-.
Please infrom me as to what stand the society should adopt in the said matter, wherein the claim has beem raised after a period of 15 months. Is the clain is legitimate?.

In the whole story, you have onitted to give the basic information, i.e., what is the official rate of transfer premium fixed by the society byelaws and what link the the transfer premium has with the amount of share of the flat owner?

he is right . the transfer preimum cnanot be more than rs 25,000 in mahrashtra
