How i get a succession certificate

dear sir,
the property detail is as per:-
land in jaipur in name of my grand mother he died and will to my grand father but this orignal "will" be lost and i have only copy of these will and my grand father will to me
please tell me that i am applicable to get succession certificate as above and how i get a succession certificate in rajsthan so please tell me how i applied,where i am applid for these(property in jaipur and i live in jodhpur).it charges and other related information.

Obtain true copy if it is a registered will and move to District Court for probation, otherwise seek sucession certificate

You can apply for the probate of the Will.

you have to make application for probate of will . the will has to be proved to be genuine . contact local lawyer

Dear Mr Amit

You have only photo copy of Will so you have to prove it by oral evidence and by deposition of two persons who were present at the time of will.

If it is contested by your other kits and kins the success reate is very poor.

You should file application at Jaipur and it costs 3% of market value of property as court Fee in Rajasthan and advocates fee and expenditure.

You may have to first get the will of your GF probated. For this purpose you have to file an application in the Dt Court where your Gf ordinarily resided at the time of his death. If your application for probate is challenged on the ground that your Gf was not the owner of the property, you will have to prove the will executed by your Gm bequeathing the property to your Gf. This will be an uphill task as the original will is lost. Better engage a senior lawyer of your place and be guided by him.
