498a bail

(Querist) 24 April 2012 This query is : Resolved 
My husband is remanded on 498A, 406. His lawyers prayed for bail. Judge asked me if i wanna live with him, he told that in that case he wld give bail. I denied and bail was not granted to him. Now the next bail hearing date is provided. I would want to deny. How to do it?

And other accused in the FIR is not yet remanded as well didnt get bail yet.

Even if you deny in the next hearing,bail will be given to your husband.Does not matter if another accused is absconding.

It is silly to know that the judge has rejected his bail on this ground which is not a legal ground at all.

Anyway engage an advocate who would guide you how to oppose bail.

priaji, if you have a right to oppose bail and the accused has also has a right to bail. In the bail matter courts usually consider the chance of hampering of investigation & tampering of evidence by the accused if bail is allowed. If the public prosecutor submitted sufficient ground that there is every possibility that the accuse may hamper the investigation or temper with evidence, court has every reason to reject his bail. But a pre trial conviction is always consider ed as bad in law. So discuss the matter with the public prosecutor concerned.
