Dear Sir,

My query is that one of my family friend offered me to purchase a land. I was agreed with the same and handed over my share to him. I gave him 2.5 lakh in cash and 70,000/- by cheque on dated 30.08.10. I filled the amount along with date in the cheque but not fill the name of the owner or any other person. So far as the documents is concerned, I did not take any document from him in the name of agreement etc. On the very next day, he came to me and said that the owner of the property is not accepting the cheque so you have to give me the cash of Rs. 70,000/- I gave him the said amount in cash. but he never return my chque to me and not dropped the same in my account. whenever I asked about the cheque he denied one pretext to other. Always he said mein kahi bahaga jaa raha hoo de dunga pada hoga wo kahi idhar udhar, m kon sa tum par case kar raha hoon. when i make a call to him and insist him to return the chque, he literally said "ab to mein tujhse 70 ke 7 lakh loonga, mera naam bhi abhishek bhardwaj he. i also lost my temper. then he said " chal tujhe abhi aakar batata hoo. Thereafter he came to my house. i was sit in my house alongwith one of my friend namely Mohit Sharma and my family membert also. He started using abusive language and literally said "saale chamar tum hamare per ki juti ho mujhse uchi awaz mein baat karta he. per ki juti per mein hi achhi lagti he. Zayad par nikal aaye tum chamaro ke pandito ki brabri karoge. Now pls suggest me the proper remedy or relief. Can he filed the suit for recovery against me by using that chque?
Can I file a criminal case against him.

Yes you can file criminal case u/s 384, 406, 506.509 of IPC.

You have won the battle now. You have to prepare your friend Sharma for evidence with one another friend and incident has to be described out of your house means a public place.


If this is prepared then file a criminal complaint to police referring your caste and enclosing its certificate. You also mention therein that your prestige has lowered down in the eyes of present persons at that time and you have been humiliated in the name of coaste.

You shall find the magic impact. Pandit ji shall have to bear pair ki juti over his head and even then he shall not be exonerated from charges. If police do not lodge FIR, come to court and file criminal complaint.

Bhardwaj ji shall return you 7 lakh instead of charging from you and even then it shall be your mercy to let him free or not.

The relevant sections of IPC as advised by Barman shall be inserted with section 3 (x) of Prevention of Atrocities on Scheduled Caste and Scheduled Tribes Act.
