(Querist) 02 April 2012 This query is : Resolved 
after putting in presence defendent never appeared on any of dates nor filed w/s. case came to exparte evidence. he moved an application for setting it aside. court agreed. case cameup for rent assessment and he again did not appear. court again posted case for exparte. can he again move an application for setting aside exparte evidence

Defendent can move application but he has to show sufficient cause for his non appearence in court on hearing day.

Moving of application by defendant is his right and further order depends upon court to allow him or not.
