dear expert,
there was a man who had 2 wife first wife have 4 children and second wife have no child first wife 2 children have alreadybeen died and second wife age is 85 years and their husband has already died now second wife have property in slum premises in her name and wants to give his property to his husband first wife son who is married son now through which document she can give her property to him and what relation she can mention in the document.

i mistakely in query that she wants to give her property to her husband son infact she wants to give her propety to her husband sons. son means her husband grand son

if the property is sin slums she must not be having proper legal documentation in this regard . is the slum legal or illegal ?

She can gift the same/ She can will the same.

However, as Mr. Sethi suggested the same can be done only if the slum has been declared legal with right of land allocated.

Dear Anithaji,

Here it does not apply to blood relation,but as the father's 2nd wife she can transfer her property to the stepson or grandchildren in the form of a gift deed.Another point is,verify if she has any kith and kin from her side,who will not create any hurdles in future.
